This notice describes how medical information about you may be used and disclosed, and how you can get access to this information. Please review it carefully.

Our obligations

We are required by law to maintain the privacy of your protected health information, to give you this notice of our legal duties and privacy practices, and to follow the terms of the notice currently in effect. We are also required to notify you if a breach affects your unsecured protected health information.

Uses and disclosures we may make without your written authorization

  • Treatment. To dispense your prescriptions, to counsel you, and to communicate with your prescribers and other providers about your care.
  • Payment. To bill and collect from an insurer, a claims administrator, or you.
  • Healthcare operations. Quality review, staff training, licensing and accreditation, and running the pharmacy.
  • As required by law. Including reporting controlled-substance dispensing to California's CURES prescription drug monitoring database, reporting to the Board of Pharmacy or the FDA where required, responding to lawful subpoenas and court orders, public health reporting, and reporting suspected abuse or neglect.
  • To people involved in your care, where you agree or where you are not present and we judge in our professional experience that it is in your best interest — for example, giving a prescription to a family member you sent to collect it.

The disclosure specific to a lien: your attorney

If you are being dispensed to on a lien or letter of protection, your law firm will receive information about what we dispensed and what it cost, because your case cannot account for the balance otherwise.

That disclosure happens only under a written authorization you sign, naming the firm. It is scoped deliberately:

  • What the firm gets: itemized billing and dispensing records for the injury-related medications and equipment supplied under the lien — drug, strength, quantity, date, prescriber and charge — plus a records affidavit if the case needs one.
  • What the firm does not get from us: your unrelated medication history, prescriptions that have nothing to do with the injury, or health conditions outside the scope of the authorization.

You may revoke that authorization in writing at any time. Revoking it does not undo disclosures already made, and it does not cancel the balance you owe.

Uses that always require your written authorization

  • Any sale of your protected health information — we do not do this.
  • Most marketing communications — we do not do this either.
  • Most psychotherapy notes, where any exist.
  • Any other use or disclosure not described in this notice.

Your rights

  • Inspect and copy your records, including an electronic copy where we hold them electronically.
  • Request an amendment if you believe something is wrong or incomplete.
  • Request an accounting of certain disclosures we have made.
  • Request restrictions on how we use or disclose your information. We are not always required to agree — but if you pay for a service in full yourself, you may restrict disclosure of that service to a health plan and we must honour it.
  • Request confidential communications at an alternative address or by an alternative means.
  • Receive a paper copy of this notice, even if you read it here.
  • Be notified following a breach of unsecured protected health information.

Complaints

You may also complain to the U.S. Department of Health and Human Services, Office for Civil Rights. We will not retaliate against you for filing a complaint.

Changes to this notice

We may change this notice and make the new terms effective for all information we hold. The current version is always posted here with its effective date.
